According to vaguardia news: The opinion will be submitted to the state legislatures, and if approved by the majority of state legislatures, the reform will be declared constitutional.
The Senate approved a controversial reform that prohibits the use of vape devices and illegal use of fentanyl in Mexico, so the reform will be submitted to 32 state legislatures before declaring its constitutionality.
The Senate plenary session approved the amendment of Articles 4 and 5 of the Political Constitution of the United Mexican States with 110 votes in favor, 5 votes against, and 2 abstentions, prohibiting the production, distribution and sale of vapes, vape devices and other systems or simulated electronic products and equipment.
It is worth noting that the purpose of this reform is to safeguard the right of Mexicans to health protection.
Through the reform, the production, distribution, marketing and sale of vapes, vape devices and other similar electronic systems or devices prescribed by law, as well as the production, distribution and sale of toxic substances and fentanyl precursors will be prohibited.
Morenoist Senator Enrique Inzunza noted that the ruling addresses a pressing problem that affects society, mainly adolescents who use vapes, toxic substances and synthetic drugs.
“First of all, we must remember that health is a fundamental right and a priority that the Mexican government is obliged to guarantee. In recent years, we have witnessed how the proliferation of electronic devices such as vapes and the increase in the use of substances such as fentanyl have led to health crises and public safety crises.”
PAN Senator Ricardo Anaya assured that a large part of senators use these devices, many of whom even hide in the bathroom to use them.
“The plenary session is packed with vapers, and those who use them hide in the bathrooms,” said the man from Querétaro.
Senator Alejandra Barrales of Movimiento Ciudadano, the only group that voted against the ruling, said the reform “aims to criminalize and punish the consumption of substances, rather than to prevent and regulate free consumption, as proposed by any left in the world.”
The reform aims to amend Articles 4 and 5 of the Constitution, and we believe it has two goals.
“First, elevate the ban on vapes, vape devices or similar systems to constitutional status.
Second, establish and prohibit the production, sale, disposal of toxic substances, chemical resources, illegal use of fentanyl and other unauthorized synthetic drugs.”
“In other words, this ban equates the use of vapes with the use of drugs such as fentanyl. Indeed, the absurdity of this is obvious, because although we recognize that the use of vape devices will undoubtedly cause harm, it is simply not comparable to the harm caused by the use of fentanyl. Its absurdity is obvious.”
The opinion will be submitted to the 32 state legislatures. If it is supported by a majority of legislators, the reform will be declared constitutional and enacted.
Comment: Last month, Mexican President Sheinbaum suddenly publicly stated that Mexico is not a backdoor for Chinese products to enter the United States and Canada. She claimed that she would prove at the US-Mexico-Canada trilateral meeting that the idea that Chinese products enter the other two countries through Mexico is wrong. At this time, the vape ban passed by the Mexican Senate cannot help but remind people of its relevance. If this is true, then the vape channel transiting through Mexico to the United States will soon be closed.
As a company that actively responds to and complies with national standards, Veehoo vape has been committed to providing high-quality and safe vape products. However, this sudden incident may bring challenges to vape brands operating in the Mexican market, and may also affect their access to the US market.
This reform of the Mexican Senate elevates the ban on vapes to a constitutional status, while prohibiting the production and sale of toxic substances, fentanyl precursors and other substances, and equating the use of vapes with the use of other drugs. This move is seen as a restriction on free consumption and a measure to protect health.
Veehoo vape will need to pay close attention to the development of this reform and adjust its business strategy according to policy changes to adapt to the new environment of various countries’ markets. At the same time, since it may affect the access of vapes to the US market, the vape industry will also face new challenges and opportunities.
In general, the vape ban passed by the Mexican Senate will have an impact on the development of vapes in the Mexican market and entering the US market. Enterprises need to pay close attention to policy changes and flexibly adjust their strategies to adapt to the new market environment and demand changes.
