According to Babel.UA on July 11, from July 11, 2024, flavored cigarettes, cigarette tobacco, vapes and vape oils will disappear from store shelves, and the packaging of all tobacco products must carry a comprehensive medical warning.

This is required by Ukrainian Law No. 1978-XI, which came into effect a year ago (July 11, 2023).

The law provides for a year to sell off remaining tobacco and nicotine products, but by July 11, this deadline had expired, so the ban has fully come into effect.

These changes were adopted in accordance with the World Health Organization’s Framework Convention on Tobacco Control and the European Integration Directive 2014/40/EU. These documents state that flavored tobacco products are addictive and the ban is intended to protect people from this harm.

From July 11, 2024, all tobacco products must carry updated health warnings on their packaging, and on 65% of the largest side area of the packaging, manufacturers must display images of diseases caused by smoking and text warnings about the dangers and consequences of smoking.

In addition, the packaging should also be accompanied by a QR code with a link to the free smoking cessation service “I Quit!” of the Public Health Center.

According to Order No. 747 of the Ministry of Health of Ukraine, new standards for the labeling of tobacco products came into force on January 11, 2024, and a total of 14 medical warnings in three groups were developed. These warnings will be updated every year, as will the disease images.

In addition, flavored cigarettes, cigarette tobacco, vapes and e-liquids containing flavoring additives must be removed from store shelves in accordance with Articles 10 and 10-1 of Law No. 1978-IX, which came into force a year ago.

In addition, it is stipulated that:

It is prohibited to add additives (such as vitamins) to tobacco products and vapes that may mislead consumers about the consequences of using these products;

Requirements for the composition of vape oils;

Reporting requirements for manufacturers and distributors of tobacco products and vapes

Until July 11, 2024, the law allows the sale of products manufactured or imported before the law comes into force.

Directive 2014/40/EU requires all EU member states to ban flavored heated tobacco products by October 2023. This requirement also applies to Ukraine. The relevant initiative has been submitted to the parliament through the draft law No. 9227.

For Veehoo vape as an vape manufacturer, this new regulation will have a certain impact. Here are the possible impacts and countermeasures that Veehoo vape may face:

1. Market adjustment: Due to the ban on the sale of flavored tobacco and vapes, Veehoo vape may need to re-evaluate its product portfolio and adjust product formulations to comply with the new regulations. They can consider developing e-liquids without flavoring additives to meet the needs of the Ukrainian market.

2. Packaging and labeling updates: According to the new regulations, the packaging of all tobacco products must be updated to comply with the new health warning and warning requirements. Veehoo vape needs to ensure that its product packaging complies with the regulations, display the correct warning pictures and texts, and add a QR code link to the smoking cessation service.

3. Compliance and reporting requirements: Veehoo vapes needs to ensure that its product formula complies with relevant regulations and meets the reporting requirements for manufacturers and distributors. They should work closely with relevant local authorities to ensure compliance and submit the required reports and documents in a timely manner.

4. Seek market diversification: Given that the Ukrainian vape market is restricted, Veehoo vapes can seek to expand its market share in other countries or regions. They can consider exporting to other countries or cooperating with partners in other countries to promote and sell their products.

In general, the new regulations in Ukraine have put forward new requirements for Veehoo vapes’ sales strategy and product formula. As a well-known vape manufacturer, Veehoo vapes can adapt to the new regulations through measures such as market adjustments, product packaging and labeling updates, compliance and reporting requirements, market education, and seeking market diversification.
