According to Prawo.pl on November 25, Poland is drafting regulations to ban the sale of vapes to minors, but the regulations are not expected to take effect until the second quarter of 2025 at the earliest.

Although the Polish government has stipulated that the sale of vapes to people under the age of 18 is prohibited, the actual implementation is not good. Health Minister Izabela Leszczyna said that the government is considering further revising the law to completely ban the sale of all types of vapes to minors.

The new draft considers extending the transition period for the implementation of the regulations. For vapes or cartridges that do not meet the requirements of the new amendment (especially nicotine-free liquid containers), they can continue to circulate on the market for no more than six months after the new regulations come into effect. The move is to introduce a six-month period in the amendment to the Tobacco Law, allowing old products (products without warning labels) to remain on the market for a period of time.

Legal advisor Katarzyna Fortak-Karasińska explained that only six months after the law came into force will products in old packaging (products without specific warnings) be banned from the market.

Another proposal is to allow the sale of containers of nicotine-free liquids larger than 10 ml (usually 60 ml) so that consumers can add nicotine themselves. Therefore, it is reasonable to limit the capacity of spare containers of nicotine-free liquids.

The new draft will extend the process of the entry into force of the regulation. Originally, a transition period of three months was assumed, but now the bill will enter into force 14 days after the publication of the Journal of Laws, but the above-mentioned transition period of six months is retained.

The regulation will require notification to the European Commission, a process that takes three months. But this project can only be submitted after the approval of the Council of Ministers, which has not yet been approved. Therefore, the Ministry of Health emphasizes that the bill should enter into force in the second quarter of 2025.
